Veroffentlichungen des Instituts fiir Europiiische Geschichte Mainz, Abt. Religionsgeschichte, Bd. 140. Stuttgart: Franz Steiner Verlag, 1989. Pp. ii + 124. DM 38 {cloth). As Denis Janz, specialist in the late medieval context of Luther's thought (Luther and Late Medieval Thomism, 1983), points out in the "Prospectus," a study of (...) Luther's understanding of Thomas has an inherent appeal, for, " rightly or wrongly, Thomas and Luther are inevitably regarded as the standard-bearers of Roman Catholicism and Protestantism" {p. 1). The recent completion of the necessary critical indices has made the task possible, and the result is a fine and necessary contribution to the work of all scholars interested in the thought of these two pivotal Christian thinkers. The method of Janz is straightforward: assemble the references to Thomas in Luther's works, organize them into appropriate categories, exegete their meanings, and discern important tendencies or perspectives common to these texts. Then "the accuracy of Luther's understanding and the cogency of his critique " can be evaluated from the perspective of twentieth cenrtury historical knowledge {p. 2). Janz recognizes that there are significant hermeneutical difficulties inherent in such a study and that any evaluation " may well imply a notion of history as progress, perhaps even a confidence in the intellectual superiority of modernity over the past " (p. 3). The result bears out the soundness of his approach. Chapter I examines "Luther on the Person of Thomas." Luther, sharing in and contributing to his time's distinctive theological polemic, had no shortage of epithets for Thomas, from " Sophist " to " beggarly paunch " {p. 4). The remarkable thing is the surprising number of complimentary things he has to say. At different times of his career Luther referred to Thomas as " this holy man " or " a man of ' great genius '... woefully misunderstood " {p. 5). A most interesting example is the different uses he makes of a story of Thomas's struggle with despair when near death, when Thomas faced his Anfechtung by holding the Bible and saying "I believe what is in this book" (p. 8). Sometimes Luther cites it as an example of the weakness of implicit faith; but other times he makes no critical comment on Thomas, and the story implies the victory of faith over despair. These different uses show the ambiguity of Luther's attitude toward Thomas as a person, and what in balance seems to be " grudging respect " for an " example of how great persons can at the same time be seriously mistaken " (p. 10). 146 BOOK REVIEWS Chapter U, which comprises the bulk of the hook, carefully examines the substantive issues on which Luther mentions and responds to Thomas: experience, the use of Aristotle, Scripture, penance and indulgences, the Lord's Supper, monasticism, justification, law, baptism, angels, papal authority, purgatory, and the veneration of images. On some of these issues Janz sees only a minor critique of Thomas by Luther and sometimes little real difference between their positions. Both Luther and Thomas give primacy to the literal sense of Scripture, and "both teach that the Church and theology stand under the authority of Scripture" (p. 30). On this question Luther's critique has more to do with the Thomists than Thomas. In regard to penance and indulgences Luther criticizes Thomas's view, though here again there is distortion of Thomas by the Thomists, which Luther correctly suspects (pp. 44-45). Though Luther disagrees with Thomas's understanding of the Lord's Supper, he feels Thomas was entitled to his opinion; what he cannot bear is how Thomas has been raised " to the level of an infallible teacher," with his opinions transformed "into articles of faith" (p. 48). Justification, the heart of Luther's thought, is "a relatively insignificant issue " in his critique of Thomas, as Luther eventually comes to understand better the key place Thomas gave grace (pp. 60, 61). Luther sees Christ as the " abrogation " of the law and criticizes Thomas for not seeing it this way; however, this is a linguistic misunderstanding of Thomas, probably based on Gabriel Bicl's teaching, so that Thomas and Luther are... Rationing healthcare is a difficult task, which includes preventing patients from accessing potentially beneficial treatments. Proponents of implicit rationing argue that politicians cannot resist pressure from strong patient groups for treatments and conclude that physicians should ration without informing patients or the public. The authors subdivide this specific programme of implicit rationing, or “hidden rationing”, into local hidden rationing, unsophisticated global hidden rationing and sophisticated global hidden rationing. They evaluate the appropriateness of these methods of rationing from the perspectives of (...) individual and political autonomy and conclude that local hidden rationing and unsophisticated global hidden rationing clearly violate patients’ individual autonomy, that is, their right to participate in medical decision-making. While sophisticated global hidden rationing avoids this charge, the authors point out that it nonetheless violates the political autonomy of patients, that is, their right to engage in public affairs as citizens. A defence of any of the forms of hidden rationing is therefore considered to be incompatible with a defence of autonomy. (shrink)

The article takes the first steps towards a general theory of civil society elites, a concept not fully developed in either elite or civil society research. This conceptual gap hampers academic and public understanding of the dynamics at the top of civil society. To address this, the authors rely on the theoretical framework of Pierre Bourdieu to build a theory of civil society elites as managers of civic capital. This role is illustrated through examples from the differently institutionalised UK and (...) Nordic civil societies. The first part of the article introduces the notion of civic capital and its emergence during the 19th century. The second part focuses on elite positions in civil society fields, demonstrating how civil society elites, as managers of civic capital, navigate between their constituents and other elite groups. These elites wield the power to consecrate social relations while misrecognising their own symbolic and economic gains. Recent scandals in the climate movement and UK and Nordic civil societies shed light on the symbolic aspects of the positions of civil society elites. This comprehensive analysis contributes to elite and civil society research and enriches public discussions about the role of civil society leaders in society. (shrink)

Consequently, legitimate allocation of healthcare has seemed almost unattainable in contemporary pluralistic societies. The problem is that citizens do not agree on (...) any single principle governing priorities among groups of patients. The Accountability for Reasonableness framework suggests an ingenious solution to this problem of moral disagreement. Rather than advocating any substantive distributive principle, its advocates propose a feasible set of conditions, which, if met by decision makers at the institutional level, provide, so it is promised, legitimate decisions. While we agree that A4R represents an important contribution to the priority-setting debate, we challenge the framework in two respects. First, we argue that A4R, and more specifically the relevance condition of A4R, does not enable healthcare institutions to generally distinguish between relevant and irrelevant reasons for priority-setting. Second, we criticize Daniels’ and Sabin's argument that A4R and deliberative democracy constitute necessary and sufficient conditions of a feasible procedure for setting legitimate limits within healthcare. The rise of “the rest,” especially China, has triggered an inevitable transformation of the so-called liberal international order. Rising powers have started to both challenge and push for the reform of existing multilateral institutions, such as the International Monetary Fund, and to create new ones, such as the Asian Infrastructure Investment Bank. The United States under the Trump administration, on the other hand, has retreated from the international institutions that the country once led or helped to create, including the Trans-Pacific (...) Partnership ; the Paris Agreement; the Iran nuclear deal; the Intermediate-Range Nuclear Forces Treaty; the United Nations Educational, Scientific and Cultural Organization ; and the United Nations Human Rights Council. The United States has also paralyzed the ability of the World Trade Organization to settle trade disputes by blocking the appointment of judges to its appellate body. Moreover, in May 2020, President Trump announced his decision to quit the Open Skies Treaty, an arms control regime designed to promote transparency among its members regarding military activities. Advance directives (ADs) have for some time been championed by ethicists and patient associations alike as a tool that people newly diagnosed with dementia, or prior to onset, may use to ensure that their future care and treatment are organized in accordance with their interests. The idea is that autonomous people, not yet neurologically affected by dementia, can design directives for their future care that caregivers are morally obligated to respect because they have been designed by autonomous individuals. In this (...) paper, we first criticize the idea that ADs can retain moral authority in severe dementia by arguing that it is paradoxical. Second, we consider two arguments that initially seem to refute this critique of ADs, but we eventually dismiss them. The first argument states that ADs retain moral authority in severe dementia because autonomously formed interests, for example, ADs, can only be appropriately discarded by autonomous persons. This we term the historical autonomy argument. We dismiss it by demonstrating how we, in analog cases, are not obligated to continue to respect autonomously formed interests even though they have been discarded under nonappropriate conditions. The second argument is that ADs can be justified by what we term external interests. While we agree that people with severe dementia plausible can be said to have external interests, we show that ADs cannot express such interests and hence cannot be justified by them. We conclude that none of the discussed arguments support the use of ADs and because of this, the idea of ADs should be reassigned. (shrink)

The inevitable need for rationing of healthcare has apparently presented the medical profession with the dilemma of choosing the lesser of two evils. Physicians appear to be obliged to adopt either an implausible version of traditional professional ethics or an equally problematic ethics of bedside rationing. The former requires unrestricted advocacy of patients but prompts distrust, moral hazard and unfairness. The latter commits physicians to rationing at the bedside; but it is bound to introduce unfair inequalities among patients and lack (...) of political accountability towards citizens. In this paper I shall argue that this dilemma is false, since a third intermediate alternative exists. This alternative, which I term 'administrative gatekeeping', makes it possible for physicians to be involved in rationing while at the same time being genuine advocates of their patients. According to this ideal, physicians are required to follow fair rules of rationing adopted at higher organizational levels within healthcare systems. At the same time, however, they are prohibited from including considerations of cost in their clinical decisions. (shrink)

We characterise the intermediate logics which admit a cut-free hypersequent calculus of the form \, where \ is the hypersequent counterpart of the sequent calculus \ for propositional intuitionistic logic, and \ is a set of so-called structural hypersequent rules, i.e., rules not involving any logical connectives. The characterisation of this class of intermediate logics is presented both in terms of the algebraic and the relational semantics for intermediate logics. We discuss various—positive as well as negative—consequences of this characterisation.

A residuated lattice is said to be integrally closed if it satisfies the quasiequations \ and \, or equivalently, the equations \ and \. Every integral, cancellative, or divisible residuated lattice is integrally closed, and, conversely, every bounded integrally closed residuated lattice is integral. It is proved that the mapping \\backslash {\mathrm {e}}\) on any integrally closed residuated lattice is a homomorphism onto a lattice-ordered group. A Glivenko-style property is then established for varieties of integrally closed residuated lattices with respect (...) to varieties of lattice-ordered groups, showing in particular that integrally closed residuated lattices form the largest variety of residuated lattices admitting this property with respect to lattice-ordered groups. The Glivenko property is used to obtain a sequent calculus admitting cut-elimination for the variety of integrally closed residuated lattices and to establish the decidability, indeed PSPACE-completenes, of its equational theory. A Heyting algebra is supplemented if each element a has a dual pseudo-complement \, and a Heyting algebra is centrally supplement if it is supplemented and each supplement is central. We show that each Heyting algebra has a centrally supplemented extension in the same variety of Heyting algebras as the original. We use this tool to investigate a new type of completion of Heyting algebras arising in the context of algebraic proof theory, the so-called hyper-MacNeille completion. We show that the (...) hyper-MacNeille completion of a Heyting algebra is the MacNeille completion of its centrally supplemented extension. This provides an algebraic description of the hyper-MacNeille completion of a Heyting algebra, allows development of further properties of the hyper-MacNeille completion, and provides new examples of varieties of Heyting algebras that are closed under hyper-MacNeille completions. In particular, connections between the centrally supplemented extension and Boolean products allow us to show that any finitely generated variety of Heyting algebras is closed under hyper-MacNeille completions. The initial purpose of this study is to provide an empirical validation of Victor and Cullen’s ethical-climate model (1987, Frederick (ed.), Research in Corporate Social Performance and Policy, Vol. 9, pp. 51–71; 1988, Administrative Science Quarterly 33, 101–125; 1990, Frederick and Preston (eds.), Business Ethics: Research Issues and Empirical Studies (JAI Press Inc., Greenwich, Connecticut), pp. 77–97). Testing the model on a sample of Danish firms, this study demonstrates that the empirical model as suggested by Victor and Cullen is much (...) stronger than suggested by previous research. Based on a confirmatory factor model, the results of this study suggest a revised ethical structure. Especially a sixth dimension – own interest – is separated from the original instrumental dimension. Further, this study suggests that the ethical-climate model can be enhanced with the dimension of autonomy deriving from Koys and DeCotiis’ (1991, Human Relations 44(3), 265–285.) dimensional psychological climate instrument. A wide range of gene knockout experiments shows that functional stability is an important feature of biological systems. On this backdrop, we present an argument for higher‐level causation based on counterfactual dependence. Furthermore, we sketch a metaphysical picture providing resources to explain the metaphysical nature of functional stability, higher‐level causation, and the relevant notion of levels. Our account aims to clarify the role empirical results and philosophical assumptions should play in debates about reductionism and higher‐level causation. Triage is a widespread principle for prioritizing patients in emergency departments. The purpose of triage is to ensure that in emergency situations, whenever medical demand exceeds medical supply, limited resources should be directed to the case with the greatest clinical need. Triage fulfills this purpose by ranking patients according to how acute their condition is and then giving priority to the most acute ones. In this paper, I argue that this current practice of triage needs to be supplemented. Contemporary triage (...) is based on a principle of preserving patients’ core capabilities, which is relevant when it comes to prioritizing acute patients above sub‐acute ones, but not for prioritizing among sub‐acute patients, which is the largest group of emergency patients. Henceforth, I propose to supplement triage with what I term the real dialogue model, a framework that, when combined with enhanced professional autonomy for clinical decision‐makers, enables fair prioritizing among sub‐acute patients. Making publics visible through digital traces has recently generated interest by practitioners of public engagement and scholars within the field of digital methods. This paper presents an experiment in moving such methods into critical proximity with political practice and discusses how digital visualizations of topical debates become appropriated by actors and hardwired into existing ecologies of publics and politics. Through an experiment in rendering a specific data-public visible, it shows how the interplay between diverse conceptions of the public as well (...) as the specific platforms and data invoked, resulted in a situated affordance-space that allowed specific renderings take shape, while disadvantaging others. Furthermore, it argues that several accepted tropes in the literatures of digital methods ended up being problematic guidelines in this space. BackgroundEthical problems in everyday healthcare work emerge for many reasons and constitute threats to ethical values. If these threats are not managed appropriately, there is a risk that the patient may be inflicted with moral harm or injury, while healthcare professionals are at risk of feeling moral distress. Therefore, it is essential to support the learning and development of ethical competencies among healthcare professionals and students. The aim of this study was to explore the available literature regarding ethics education that (...) promotes ethical competence learning for healthcare professionals and students undergoing training in healthcare professions.MethodsIn this integrative systematic review, literature was searched within the PubMed, CINAHL, and PsycInfo databases using the search terms ‘health personnel’, ‘students’, ‘ethics’, ‘moral’, ‘simulation’, and ‘teaching’. In total, 40 articles were selected for review. These articles included professionals from various healthcare professions and students who trained in these professions as subjects. The articles described participation in various forms of ethics education. Data were extracted and synthesised using thematic analysis.ResultsThe review identified the need for support to make ethical competence learning possible, which in the long run was considered to promote the ability to manage ethical problems. Ethical competence learning was found to be helpful to healthcare professionals and students in drawing attention to ethical problems that they were not previously aware of. Dealing with ethical problems is primarily about reasoning about what is right and in the patient’s best interests, along with making decisions about what needs to be done in a specific situation.ConclusionsThe review identified different designs and course content for ethics education to support ethical competence learning. The findings could be used to develop healthcare professionals’ and students’ readiness and capabilities to recognise as well as to respond appropriately to ethically problematic work situations. Inference has long been a concern in epistemology, as an essential means by which we extend our knowledge and test our beliefs. Inference is also a key notion in influential psychological or philosophical accounts of mental capacities, from perception via utterance comprehension to problem-solving. Consciousness, on the other hand, has arguably been the defining interest of philosophy of mind over recent decades. Comparatively little attention, however, has been devoted to the significance of consciousness for the proper understanding of the nature (...) and role of inference. It is commonly suggested that inference may be either conscious or unconscious. Yet how unified are these various supposed instances of inference? Does either enjoy explanatory priority in relation to the other? In what ways or senses, can an inference be conscious, or fail to be conscious, and how does this matter? This book brings together original essays from established scholars and emerging theorists that illustrate how several current debates in epistemology, philosophy of psychology, and philosophy of mind can benefit from reflections on these and related questions about the significance of consciousness for inference. New technologies and practices, such as drug testing, genetic testing, and electronic surveillance infringe upon the privacy of workers on workplaces. We argue that employees have a prima facie right to privacy, but this right can be overridden by competing moral principles that follow, explicitly or implicitly, from the contract of employment. We propose a set of criteria for when intrusions into an employee''s privacy are justified. Three types of justification are specified, namely those that refer to the employer''s interests, (...) to the interests of the employee her- or himself, and to the interests of third parties such as customers and fellow workers. For each of these three types, sub-criteria are proposed that can be used to determine whether a particular infringement into an employee''s privacy is morally justified or not. (shrink)

Kerry et al. criticize our discussion of causal knowledge in evidence-based medicine (EBM) and our assessment of the relevance of their dispositionalist ontology for EBM. Three issues need to be addressed in response: (1) problems concerning transfer of causal knowledge across heterogeneous contexts; (2) how predictions about the effects of individual treatments based on population-level evidence from RCTs are fallible; and (3) the relevance of ontological theories like dispositionalism for EBM.

MILLIANISM and DESCRIPTIVISM are without question the two most prominent views with respect to the semantics of proper names. However, debates between MILLIANS and DESCRIPTIVISTS have tended to focus on a fairly narrow set of linguistic data and an equally narrow set of problems, mainly how to solve with Frege's puzzle and how to guarantee rigidity. In this article, the author focuses on a set of data that has been given less attention in these debates—namely, so-called predicative uses, bound uses, (...) and shifted uses of names. The author first shows that these data points seem to favor a DESCRIPTIVIST view over a MILLIAN view, but the author then introduces an alternative view of names that not only provides a simple and elegant way of dealing with the data, but also retains rigidity without becoming subject to the problems raised by Frege's puzzle. Understanding how individual agency and group agency relate is of great importance for a range of philosophical and practical concerns, including responsibility ascription and institutional design. This article discusses the relation between corporate and individual responsibility in agency—in particular, the relation between corporate and individual control of actions. First, I criticize Christian List and Philip Pettit’s causal account of combined corporate and individual control. Second, I develop an alternative account in terms of structural control, and I show how this gives (...) a better grasp of the issue. Third, I argue for an act-dualism that complements my account of control and sheds further light on the relation between corporate and individual agency and responsibility. (shrink)

Purpose – This paper has three purposes: to identify and discuss values that should be promoted and respected in personal health monitoring, to formulate an ethical checklist that can be used by stakeholders, and to construct an ethical matrix that can be used for identifying values, among those in the ethical checklist, that are particularly important to various stakeholders. Design/methodology/approach – On the basis of values that empirical studies have found important to various stakeholders in personal health monitoring, the author (...) constructs an ethical checklist and an ethical matrix. The author carries out a brief conceptual analysis and discusses the implications. Findings – The ethical checklist consists of three types of values: practical values that a technical product in personal health monitoring must have, quality of life values to be promoted by the development and use of the product, and moral values to be respected in this development and use. To give guidance in practice, the values in the checklist must be interpreted and balanced. The ethical matrix consists of the values in the checklist and a number of stakeholders. Originality/value – The overall ambition is to suggest a way of categorizing values that can be useful for stakeholders in personal health monitoring. In order to achieve this, the study takes empirical studies as a starting-point and includes a conceptual analysis. This means that the proposals are founded on practice rather than mere abstract thinking, and this improves its usability. (shrink)

Anders Pettersson presents a comprehensive account of the foundations of literature, grounded in an original analysis of the interactions between author and reader. Drawing on post-Gricean pragmatics and Nicholas Wolterstorff's notion of presentationality, Pettersson develops the idea of the verbal text and conveys an integrated and nuanced understanding of literary experience, its conditions, and the values it affords. Today, many liberal philosophers of education worry that certain kinds of education may frustrate the development of personal autonomy, with negative consequences for the individuals concerned, the liberal state, or both. Autonomy liberals hold not only that we should promote the development of autonomy in children, but also that this aim should be compulsory for all schools, private or public, religious or nonreligious. In this article, Anders Schinkel provides a systematic overview, categorization, and analysis of liberal arguments for compulsory (...) autonomy‐promoting education. He finds that none of these arguments can justify compulsory autonomy‐promoting education, whether because they depend on empirical evidence that is not available, because they have as their basis an overly demanding concept of autonomy, or because they are intrinsically flawed in some way or another. The orthodox view of proper names, Millianism, provides a very simple and elegant explanation of the semantic contribution of referential uses of names–names that occur as bare singulars and as the argument of a predicate. However, one problem for Millianism is that it cannot explain the semantic contribution of predicative uses of names. In recent years, an alternative view, so-called the-predicativism, has become increasingly popular. According to the-predicativists, names are uniformly count nouns. This straightforwardly explains why names can be used (...) predicatively, but is prima facie less congenial to an analysis of referential uses. To address this issue, the-predicativists argue that referential names are in fact complex determiner phrases consisting of a covert definite determiner and a count noun—and so, a referential name is a definite description. In this paper, I will argue that despite the appearance of increased theoretical complexity, the view that names are ambiguous between predicative and referential types is in fact superior to the unitary the-predicativist view. However, I will also argue that to see why this ambiguity view is better, we need to give up the standard Millian analysis. Consequently, I will first propose an alternative analysis of referential names that retains the virtues of Millianism, but provides an important explanatory connection to the predicative uses. Once this analysis of names is adopted, the explanation for why names are systematically ambiguous between referential and predicative types is both simple and elegant. Second, I will argue that the-predicativism has the appearance of being simpler than an ambiguity view, but is in fact unable to account for certain key properties of referential names without making ad hoc stipulations. In _Plato on Democracy and Political technē_ Anders Dahl Sørensen offers an in-depth investigation of Plato’s discussions of democracy’s ‘epistemic potential’, arguing that this question is far more central to his political thought than is usually assumed.

Ethical dilemmas are common in the neonatal intensive care setting. The aim of the present study was to investigate the opinions of Swedish physicians and the general public on treatment decisions regarding a newborn with severe brain damage. We used a vignette-based questionnaire which was sent to a random sample of physicians (n = 628) and the general population (n = 585). Respondents were asked to provide answers as to whether it is acceptable to discontinue ventilator treatment, and when it (...) actually is discontinued whether or not it was acceptable to use drugs which hasten death unintentionally or intentionally. The response rate was 67 % of physicians and 46 % of the general population. A majority of both physicians [56 % (CI 50–62)] and the general population [53 % (CI 49–58)] supported arguments for withdrawing ventilator treatment. A large majority in both groups supported arguments for alleviating the patient’s symptoms even if the treatment hastened death, but the two groups display significantly different views on whether or not to provide drugs with the additional intention of hastening death, although the difference disappeared when we compared subgroups of those who were for or against euthanasia-like actions. The study indicated that physicians and the general population have similar opinions regarding discontinuing life-sustaining treatment and providing effective drugs which might unintentionally hasten death but seem to have different views on intentions. The results might be helpful to physicians wanting to examine their own intentions when providing adequate treatment at the end of life. (shrink)

Russell’s theory of acquaintance construes perceptual awareness as at once constitutively independent of conceptual thought and yet a source of propositional knowledge. Wilfrid Sellars, John McDowell, and other conceptualists object that this is a ‘myth’: perception can be a source of knowledge only if conceptual capacities are already in play therein. Proponents of a relational view of experience, including John Campbell, meanwhile voice sympathy for Russell’s position on this point. This paper seeks to spell out, and defend, a claim that (...) offers the prospects for an attractive, unacknowledged element of common ground in this debate. The claim is that conceptual capacities, at least in a certain minimal sense implicit in McDowell’s recent work, must be operative in perceptual experience, if it is to rationalize judgement. The claim will be supported on the basis of two premises, each of which can be defended drawing, inter alia, on considerations stressed by Campbell. First, that experience rationalizes judgement only if it is attentive. Second, that attention qualifies as a conceptual capacity, in the noted, minimal sense. The conjunction of the two premises might be dubbed ‘attentional conceptualism’. (shrink)
